In recent news the DIR adopted rules to extend the deadline for those injured workers who may have received their Supplemental Job Displacement Benefit voucher between the time period of April 13th, 2015 through December 1st, 2015 but were denied the additional RTWS benefit.

In recent news the DIR adopted rules to extend the deadline for those injured workers who may have received their Supplemental Job Displacement Benefit voucher between the time period of April 13th, 2015 through December 1st, 2015 but were denied the additional RTWS benefit.

Reasons being were similar to putting the cart ahead of the horse. In this instance the Return-to-Work Supplement Program, which was created by SB 863, did not have the proper updated forms and processes paved until October of 2015; nor did any formal or informal notice go out to those who fall under the criteria in obtaining this benefit. In February of 2016, a petition was filed with the DIR to extend the deadline. The petition’s argument was enough to right the wrong and extend this opportunity for those who were denied & fell within the timeline. The DIR also said that those injured workers who were denied of the supplement benefit will not need to re-apply but rather their cases will be reopened, reviewed and a current determination will be issued within 60 Days. This extension, or what I like to call window of opportunity, is until March 20th, 2018. Although we have more than enough time to pursue this, the fact is that the injured may not have the luxury to take their time.
